BESTRATE.IN a website is an electronic publication and a service provider.

Any and all use of this website is subject to, and constitutes acknowledgment and acceptance of the following terms.

BESTRATE.IN may amend these Terms of Use at any time by posting the amended version on this site. Such amended version shall automatically be effective upon its posting on this site.

Services of BESTRATE.IN are available only to those individuals, firms or companies who can form legally binding contracts under the Indian laws. Therefore, you must not be a minor, i.e., you must be at least 18 years of age to be eligible to use our services.

Web site acts as a mere venue/platform for our members to negotiate/interact for buying, selling and other business services by way of locating companies to trade with, through our on-line exchange.

We do not take part in the actual transaction that takes place between the buyers and sellers and hence are not a party to any contract for sale negotiated between buyers and sellers. All transactions will be the responsibility of the members only. This agreement shall not be deemed to create any partnership, joint venture, or other joint business relationship between BESTRATE.IN and other   party,

Agreement, a "User" is any person who accesses the Site for whatever purpose, regardless of whether said User has registered with BESTRATE.IN as a registered User or whether said User is a paying customer for a specific service provided by BESTRATE.IN A User includes the person using this Site and any legal entity which may be represented by such person under actual or apparent authority.

Most content and some of the features on the web site are made available to visitors free of charge. However, BESTRATE.IN reserves the right to terminate access to certain areas or features of the web site (to paying or registered users) at any time for any reason, with or without notice. BESTRATE.IN also reserves the universal right to deny access to particular users to any/all of its services/content without any prior notice/explanation in order to protect the interests of BESTRATE.IN and/or other visitors to the web site.   •  Post any material to members that is not related to international trade or business cooperation.
  •  Impersonate or unlawfully use another companies name to post information or conduct business of any form.
  •  Any unauthorized access, use, modification, or control of the web site data base, network or related services.

BESTRATE.IN provides an on-line platform for exchanging information products and services. Web site does not represent the seller or the buyer in specific transactions and does not charge any commission for enabling any transaction.

Web site does not control and is not liable to or responsible for the quality, safety, lawfulness or availability of the products or services offered for sale on the web site or the ability of the suppliers to complete a sale or the ability of buyers to complete a purchase. User(s) are cautioned that there may be risks of dealing with foreign nationals or people acting under false pretenses. Web site uses several techniques (such as Trust Seal ) to verify the accuracy and authenticity of the information our user(s) provide us. However, since it is not possible in all cases and is not 100% fool-proof, BESTRATE.IN cannot and does not confirm each user(s) purported identity (including,without limitation,Trust Seal Members).

BESTRATE.IN encourages user(s) to use various tools available on the web site and otherwise, as well as common sense, to evaluate the user(s) with whom they would like to deal with.

(C)  Any material downloaded or otherwise obtained through the Site is done at each User's sole discretion and risk and each User is solely responsible for any damage to its computer system or loss of data that may result from the download of any such material. No advice or information, whether oral or written, obtained by any User from BESTRATE.IN or through or from the Site shall create any warranty not expressly stated herein.

(E) Each User hereby agrees to indemnify and save BESTRATE.IN,  its affiliates,  officers and employees harmless, from any and all losses, claims, liabilities (including legal costs on a full indemnity basis) which may arise from such User's use of the Site (including but not limited to the display of such User's information on the Site) or from its breach of any of the terms and conditions of this Agreement. Each User hereby further agrees to indemnify and save BESTRATE.IN, its affiliates, officers and employees harmless, from any and all losses, claims, liabilities (including legal costs on a full indemnity basis) which may arise, directly or indirectly, as a result of any claims asserted by Third Party Rights claimants or other third parties relating to products offered or displayed on the Site. Each User hereby further agrees that BESTRATE.IN  is not responsible and shall have no liability to it, for any material posted by others; including defamatory, offensive or illicit material and that the risk of damages from such material rests entirely with each User. BESTRATE.IN  reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you shall cooperate with BESTRATE.IN in asserting any available defenses..

(F) The User is warned against disclosure of any personal / confidential / sensitive information to any previous or current employee of the company. The User would do so solely at his / her own risk and Site / Company shall not be liable for the outcome of any such transaction of information including and not limited to damages for loss of profits or savings, business interruption, loss of information or repute.

(G) BESTRATE.IN  shall not be liable for any special, direct, indirect, punitive, incdental or consequential damages or any damages whatsoever (including but not limited to damages for loss of profits or savings, business interruption, loss of information), whether in contract, negligence, tort, strict liability or otherwise or any other damages resulting from any of the following:
Any defect in goods, samples, data, information or services purchased or obtained from a User or a third-party service provider through the Site;
Violation of Third Party Rights or claims or demands that Users' manufacture, importation, distribution, offer, display, purchase, sale and/or use of products or services offered or displayed on the Site may violate or may be asserted to violate Third Party Rights; or claims by any party that they are entitled to defense or indemnification in relation to assertions of rights, demands or claims by Third Party Rights claimants; unauthorized access by third parties to data or private information of any User; statements or conduct of any User of the Site; or any matters relating to Paid Services however arising, including negligence.

BESTRATE.IN  is the sole owner of all the rights to the Site and the BESTRATE.IN  Content. All title, ownership and intellectual property rights in the Site and BESTRATE.IN Content shall remain with BESTRATE.IN, its affiliates or licensors of the BESTRATE.IN Content, as the case may be. All rights not otherwise claimed under this Agreement or by BESTRATE.IN are hereby reserved.
